Le Petit Parties Couture, LLC, Acknowledgement and Release of Liability
In exchange for participation in party/lessons activities (“the Activities”) at Le Petit Parties Couture, LLC, (LPPC) the undersigned agrees to the following:
I recognize and understand that there are certain inherent risks associated with participating in the Activities at LPPC, I assume full responsibility for self/child/guest injury, and further release and discharge LPPC for any injury, loss, or damage arising out of usage or presence at the facilities of LPPC, whether caused by fault of myself, my guests/child, LPPC, or other third parties. Risks include, but are not limited to: Clients/guests/children/students receiving injuries of any kind, clients/guests/children that experience allergic reactions, clients/guests/children choking on food items, clients/guests/children choking on small party items (beads, favors, toys etc.). LPPC, does not have an AED device at our facilities and does not employ trained medical personnel. In case of an emergency or serious injury, LPPC will call 911 if necessary but will not be held responsible for any ambulance trip costs or medical treatment of any kind.
Products served in this facility may contain or have been processed in a facility that also possesses or has been in direct or indirect contact with protein derived from milk, eggs, tree nuts, wheat, peanuts, soybeans, strawberries, food colorant and other food type allergens. I acknowledge that I am responsible for informing guests of this information prior to the Activities. Inquiring with guests and their parents if there are any allergies and informing LPPC so we may be aware.
I acknowledge that I, my child, and guests are participating voluntarily, and that all risks have been made clear to me. Additionally, I do not have, or know of any guests that have any conditions that will increase likelihood of experiencing injuries while engaging in activities at LPPC. I agree that all minor children will be supervised by an adult at all times (such as parent or other personally assigned guardian – and not a representative of LPPC).
I agree to indemnify and hold harmless LPPC, against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from self/guest/child use of or presence upon the facilities of LPPC.
I agree to pay for all damages to the facilities of LPPC caused by self/guest/child negligent, reckless or willful actions.
LPPC reserves the right to use any photograph/video taken at any event held at their venue, without the expressed written permission of those included within the photograph/video. LPPC may use the photograph/video in publications or other media material produced, used or contracted by LPPC including but not limited to: social media, brochures, invitations, books, newspapers, magazines, television, websites, etc. To ensure the privacy of individuals and children, images will not be identified using full names or personal identifying information without written approval from the photographed subject, parent or legal guardian. A person attending LPPC who does not wish to have their image recorded for distribution should make their wishes known to LPPC and/or the event organizers. By participating in LPPC event or by failing to notify LPPC in writing, your desire to not have your photograph used by LPPC, you are agreeing to release and indemnify LPPC from any and all claims involving the use of your picture or likeness. Any person or organization not affiliated with LPPC may not use, copy, alter or modify LPPC photographs, graphics, videography or other, similar reproductions or recordings without the advance written permission of an authorized designee from LPPC.
Any legal or equitable claim that may arise from participation in the above must be resolved under Texas law. Venue for any cause of action will be in Comal County.
